1. 誰是實際提供信託服務的法律實體?
家族應了解合約中的受託人是誰、在哪一個司法管轄區成立、受甚麼法律規管,以及日後由哪一個實體持有或管理信託資產。品牌名稱、銀行集團名稱或前線客戶經理名稱,未必等同實際承擔受託人責任的法律實體。
在香港,從事信託或公司服務業務的人士一般須受信託或公司服務提供者(Trust or Company Service Provider,TCSP)牌照制度規管。家族可使用公司註冊處 TCSP Registry 的公開名冊,按服務提供者名稱或牌照號碼查閱相關資料。香港 TCSP 持牌人公開名冊可供公眾搜尋。

How Should Hong Kong Families Choose a Trust Company?
Choosing a trust company should not be based only on setup fees, annual administration fees, or brand recognition. For a Hong Kong family, the more important questions are whether the proposed trustee understands the family’s long-term objectives, can handle the relevant assets and cross-border needs, and can execute the arrangement clearly and reliably over many years.
A family trust may be relevant to wealth succession, care for minor children, family-business continuity, long-term distributions, cross-border assets, family governance, and the continuity of information. A trust is not, however, a standardised product. Trustees, banks, independent trust companies, and other providers may differ in their legal entities, service scope, asset-acceptance policies, operational processes, and fee structures.
Start by Clarifying Family Needs, Then Compare Trust Companies
Many families begin by asking, “Which trust company in Hong Kong is best?” A more useful question is, “What do we want the trust to help us achieve?”
Before comparing any trustee or trust-service provider, a family can first clarify:
- What it wishes to protect: assets, people, a business, lifestyle security, family values, or family relationships;
- Whether there are minor children, elderly parents, family members with special needs, or other long-term care requirements;
- Whether ownership, voting rights, management rights, and economic benefits of a family business need different treatment;
- Which assets are involved: cash, listed investments, private companies, property, insurance, funds, private investments, or other illiquid assets;
- Whether family members, assets, businesses, or tax connections involve Hong Kong, Mainland China, or other jurisdictions;
- Who currently holds key account access, corporate records, policies, wills, adviser contacts, and decision-making authority; and
- How the family and business would continue if a key decision-maker were incapacitated, died, or could no longer fulfil that role.
Once needs are clearer, the family can assess the trustee capabilities, service model, and cross-professional support required. This helps avoid making a long-term decision only because of the lowest quotation, a personal introduction, or a single brand.
Ten Questions Hong Kong Families Should Ask When Comparing Trust Companies
1. Which legal entity will actually provide the trust service?
Understand who the contracting trustee is, where it is established, which laws apply, and which entity will hold or administer trust assets. A brand name, banking-group name, or relationship manager is not necessarily the legal entity assuming trustee responsibilities. Persons carrying on trust or company service business in Hong Kong generally fall within the Trust or Company Service Provider (TCSP) licensing regime. Families can use the Hong Kong TCSP public register to check information by provider name or licence number.
2. Is the trustee appropriate for the family’s relevant jurisdictions?
Hong Kong families often have cross-border circumstances: family members may live, work, study, own property, retire, or hold assets in Mainland China, the United Kingdom, Canada, Australia, the United States, Singapore, or elsewhere. A trust company may not offer the same service capability or coordination support in every location. Ask which law will govern the trust, whether the provider understands the family’s relevant jurisdictions, how it coordinates with qualified advisers, how it handles cross-border assets, documents, distributions, and data disclosure, and whether a change of residence would trigger a review.
3. Which assets can the trust company accept?
Trustees may have different policies for asset types, minimum size, valuation, liquidity, and ongoing administration. Do not assume every trustee will accept private-company shares, overseas property, private investments, art, or other non-standard assets. Ask about cash, listed portfolios, family-business shares, property, insurance interests, funds, private equity, venture investments, collectibles, and assets subject to loans, guarantees, security, or shareholder-agreement restrictions. Acceptance does not itself mean suitability; transferability, valuation, custody, decision-making, and cost still need to be considered.
4. Who will actually serve the family day to day?
Trust arrangements can continue for years or generations. Beyond the institution’s brand, ask who will be the primary relationship manager, trust administrator, and back-up contact; whether the team has relevant experience; how family context and records will be handed over if personnel change; what communication channels and response expectations apply; and whether support is available in Chinese, English, and other languages relevant to the family.
5. How are distributions, reporting, and urgent matters handled?
Trust documentation matters, but daily operation matters too. Ask about the process, information requirements, typical timing, and communication for education, healthcare, living expenses, housing, business operations, or urgent situations. Clarify who can request a distribution, who receives notices or reports, how often valuations, fees, and distribution records are reported, and how major private-company or investment matters are handled.
6. How are trustee powers and family oversight balanced?
Families should understand the powers and responsibilities of the trustee, settlor, beneficiaries, protector, investment adviser, family committee, and any other roles in the trust documents. Ask who can appoint, remove, or replace a trustee; whether a protector or other oversight role is appropriate; what additional process applies to major investments, business sales, changes to distribution policy, or material payments; and how disagreements are escalated or resolved.
7. Are fees clear, complete, and sustainable?
Setup and annual administration fees are only the start. Ask about asset transfer, valuation, custody, investment management, legal, accounting, tax filing, special assets, urgent matters, trustee replacement, restructuring, and termination. A lower quotation may not be the lower total cost or the more suitable long-term service. Transparency, predictability, operational capability, and continuity also matter.
8. How are privacy, compliance, and conflicts of interest handled?
Trust arrangements often involve highly sensitive personal, family, corporate, and financial information. Ask where information is retained, what cybersecurity and access controls apply, how disclosures are managed, and how cross-border data is handled. Also ask whether the provider may use affiliated investment products, banks, asset-management, custody, corporate, or other services, and how those arrangements, fees, and alternatives are disclosed.
9. Can the trustee be changed if needed?
A trust is a long-term arrangement, so families should understand the exit mechanism from the outset. If service quality, team, jurisdiction, family needs, or trustee strategy changes materially, the ability to replace the trustee can be important. Ask who may begin the process, whether a successor or appointment mechanism can be specified in advance, how assets and records transfer, what timing and professional costs may arise, and which law and dispute-resolution mechanism applies.
10. Can the trust company work effectively with the family’s wider professional team?
A trust does not operate in isolation. It may need to coordinate with a family business, banks, investment advisers, lawyers, accountants, tax advisers, insurance advisers, property managers, and family members. Ask how the trustee obtains appropriate authority, shares necessary information, records decisions, and manages differences among professional opinions. For entrepreneurs, cross-border families, and families with long-term care needs, respectful coordination and clear allocation of responsibilities can matter more than a single product or quotation.
