English version below

English versionThe first question is not “Which trust company is best?” It is: “What problem is our family trying to solve, and what do we want to protect?”

For Hong Kong families, a trust may form part of wider planning for succession, minor children, long-term care, business ownership, family governance, and cross-border arrangements. Whether it is appropriate—and how it should be structured—depends on the family’s actual circumstances, not simply a provider’s name or fee quotation.

Start with the family’s purpose

Before discussing trustees or jurisdictions, families should clarify what they want to protect, which risks concern them, how the next generation may participate, and who can continue urgent family and business decisions if the principal decision-maker becomes unable to act.

Five areas to clarify first

  • Family and care: beneficiaries, minor children, older relatives, special-needs or long-term-care arrangements, and the desired flexibility of distributions.
  • Assets and information: bank and investment accounts, companies, real estate, insurance, liabilities, wills, key documents, and adviser relationships.
  • Business and succession: economic benefit, ownership, voting rights, and management authority may need to be considered separately.
  • Cross-border factors: residences, tax connections, asset locations, business operations, governing laws, and future relocation or education plans.
  • Governance and decisions: trustee powers, oversight roles, replacement mechanisms, major-decision processes, and family communication.

Choose a trustee afterward

Once needs are clearer, families can compare trust companies, professional trustees, banks, and other service providers. They should look beyond setup and annual fees at acceptable asset types, team continuity, cross-border and family-business experience, distribution and reporting processes, privacy, conflicts management, and trustee-replacement arrangements.
